STANDARD TERMS AND CONDITIONS OF SALE

1. General

These Terms and Conditions of Sale (“Terms”) apply to all transactions conducted with Mittal’s Apparels (“Company”, “we”, “our”, or “us”) through our physical stores, online platforms, or mobile applications. By purchasing any product or service from us, you (“Customer”, “you”, or “your”) agree to abide by these Terms. These Terms form a legally binding agreement governing all aspects of the sale, including order placement, payment, delivery, and product use. Mittal’s Apparels reserves the right to modify or amend these Terms at any time without prior notice, and such changes shall become effective immediately upon publication. You are encouraged to review the Terms periodically to stay informed about updates. Any failure by us to enforce any provision of these Terms shall not constitute a waiver of our rights. By engaging with our platform, you affirm that you have the legal capacity and authority to enter into this agreement.

2. Products

All products offered by Mittal’s Apparels are subject to stock availability at the time of order. Product descriptions, specifications, and prices are displayed as accurately as possible; however, variations in color, size, texture, or finish may occur due to lighting, screen resolution, or manufacturing differences. Product images are for illustrative purposes only and may not always represent the exact item received. We reserve the absolute right to modify, discontinue, or withdraw any product from sale without prior notice. Mittal’s Apparels strives to maintain up-to-date and accurate product information, but inadvertent errors may occur, and we disclaim any responsibility for typographical, pricing, or descriptive inaccuracies. By placing an order, you acknowledge that minor variations between the displayed and actual product do not constitute grounds for return or refund. The Company’s decisions regarding product availability and specifications are final and binding.

3. Prices & Payment

All product prices displayed on our platform are inclusive of applicable Goods and Services Tax (GST) and other statutory levies, unless otherwise stated. Prices are subject to change at any time without prior notification, at the sole discretion of Mittal’s Apparels. Payment for purchases can be made via secure online payment gateways, digital wallets, UPI, or Cash on Delivery (COD), subject to availability and service area. Orders will be processed only upon successful receipt of full payment, except in the case of COD. Any discounts, coupons, or promotional offers are time-limited and non-transferable. The Company reserves the right to cancel or reject any order due to payment discrepancies, suspected fraud, or pricing errors. Customers are responsible for ensuring accurate billing and payment information. In the event of payment disputes, Mittal’s Apparels’ decision will be considered final. Ownership of products transfers only upon full payment confirmation.

4. Orders & Acceptance

An order placed by you constitutes an offer to purchase products from Mittal’s Apparels in accordance with these Terms. Receipt of an order acknowledgment does not imply acceptance; a binding contract is established only when we issue a written or email confirmation of order acceptance. We reserve the right to accept or reject any order at our discretion, including cases involving pricing errors, stock shortages, suspicious activity, or incomplete payment. If an order is cancelled before dispatch, any payment made will be refunded in accordance with our refund policy. Mittal’s Apparels shall not be liable for any delay or failure in processing your order resulting from circumstances beyond our control. Customers are required to provide accurate details during order placement; inaccuracies may result in cancellation or delivery delays. Once an order is confirmed, requests for changes or cancellations may not be accommodated.

5. Shipping & Delivery

Mittal’s Apparels offers delivery services across India, with applicable shipping charges determined by location and order size. Standard delivery is free for all orders within Bokaro district, while customers outside Bokaro will bear nominal courier fees. Estimated delivery timelines are provided for convenience but are not guaranteed, as they depend on courier service performance and unforeseen circumstances. Once an order has been dispatched from our facility, the risk of loss, theft, or damage passes to the customer. Customers are advised to inspect packages upon delivery and report any visible damage immediately. Delays caused by incorrect addresses, unavailability of the recipient, or logistical disruptions will not constitute grounds for cancellation or refund. Mittal’s Apparels strives to dispatch orders promptly, but delivery delays due to force majeure events or courier issues shall not attract liability. Tracking details will be shared upon dispatch for customer convenience.

6. Returns, Exchanges & Refunds

Mittal’s Apparels strives to ensure that every customer receives high-quality, correctly fulfilled orders. However, returns are accepted only within Bokaro district and must comply with our return policy. Customers residing outside Bokaro are not eligible for returns or exchanges under any circumstances. Products can be exchanged within seven (7) days of delivery only in cases of manufacturing defects, incorrect size (if applicable), or dispatch of an incorrect item. Returned items must be unused, unwashed, and accompanied by their original tags and packaging. No cash refunds will be provided; only exchange or replacement is offered. Shipping charges are non-refundable. Items marked as “sale,” “clearance,” or “custom-made” are strictly non-returnable and non-exchangeable. Mittal’s Apparels reserves the right to inspect returned goods before approving any exchange. The Company’s decision regarding eligibility for exchange shall be final. Exchanges once processed are considered conclusive and cannot be reversed or modified.

7. No Warranty

All products sold by Mittal’s Apparels are provided strictly on an “as-is” basis. Except as required by applicable law, no warranties—express, implied, or statutory—are provided with respect to the quality, durability, fitness for a particular purpose, or merchantability of our products. While we maintain stringent quality control standards, minor variations in texture, color, or design are inherent to the apparel manufacturing process and do not constitute defects. Customers are responsible for proper care and maintenance of purchased items in accordance with product care labels. Mittal’s Apparels shall not be liable for damage resulting from misuse, negligence, improper washing, or alteration of garments after purchase. To the fullest extent permitted by law, we disclaim all liability for incidental or consequential damages arising from product use. No agent or representative of the Company is authorized to extend or modify warranty terms in any manner.

8. Intellectual Property

All trademarks, brand names, logos, images, product designs, photographs, written content, and digital materials displayed or distributed by Mittal’s Apparels remain the exclusive intellectual property of the Company. These assets are protected under Indian copyright, trademark, and intellectual property laws. Customers and website visitors are granted limited permission to access and use content solely for personal, non-commercial purposes related to product purchase. Any unauthorized reproduction, duplication, modification, or resale of our intellectual property—whether online or offline—is strictly prohibited and may result in legal action. You may not copy, transmit, distribute, or use any Company materials for promotional or commercial gain without our prior written consent. Mittal’s Apparels retains the right to monitor, investigate, and take enforcement measures against infringement or misuse. All rights not expressly granted herein are reserved. Any violation of these rights may lead to suspension of service and potential civil or criminal liability.

9. Privacy & Data Use

Mittal’s Apparels values your privacy and is committed to protecting your personal data in compliance with applicable data protection laws in India. Information collected from customers—including names, contact numbers, addresses, and payment details—is used solely for order processing, delivery, communication, and fraud prevention. We may also utilize your information to improve customer experience, reduce return-to-origin (RTO) rates, and send promotional or marketing updates. By completing a purchase, you consent to our use of your data for these purposes. You may opt out of marketing communications at any time by contacting customer support. We employ industry-standard security protocols to safeguard your information against unauthorized access or disclosure. However, we shall not be held liable for data breaches arising from factors beyond our control. Your continued interaction with our platform signifies acceptance of our privacy practices and consent to data processing as described herein.

10. Governing Law & Dispute Resolution

These Terms and any transactions between you and Mittal’s Apparels shall be governed exclusively by the laws of the State of Jharkhand, India. In the event of any dispute, controversy, or claim arising from or related to these Terms or your purchase, both parties agree to resolve the matter through arbitration or mediation conducted in Bokaro, Jharkhand. The arbitration shall be governed by the Arbitration and Conciliation Act, 1996, and the decision of the appointed arbitrator shall be final and binding. Court proceedings will not be initiated unless arbitration fails to reach a resolution. Each party shall bear its own costs related to dispute resolution unless otherwise determined by the arbitrator. The use of this mechanism aims to ensure quick, fair, and cost-effective settlement of conflicts. By agreeing to these Terms, you waive the right to pursue class actions or other collective legal proceedings against the Company.

11. Amendments

Mittal’s Apparels reserves the right to revise, amend, or update these Terms and Conditions of Sale at any time without prior notice. Such modifications shall take effect immediately upon being posted on our official website or communicated through other Company channels. Continued use of our services, website, or mobile application following any amendment signifies your acceptance of the updated Terms. We recommend customers review this document periodically to remain informed of their rights and obligations. No employee, representative, or distributor is authorized to alter or modify these Terms verbally or in writing without formal approval from Company management. The version of the Terms in effect at the time of purchase shall apply to that transaction. Mittal’s Apparels shall not be held liable for any misunderstanding resulting from a customer’s failure to review the most recent Terms available online.

12. Force Majeure

Mittal’s Apparels shall not be held responsible or liable for any delay, failure, or disruption in fulfilling obligations under these Terms due to causes beyond our reasonable control. Such causes may include, but are not limited to, acts of God, natural disasters, fires, floods, pandemics, wars, strikes, labor disputes, government restrictions, transportation delays, or interruptions in supply chains. During such events, the Company’s obligations shall be suspended until the affected circumstances cease. We will make reasonable efforts to notify customers of delays and resume operations promptly. Customers acknowledge that delivery timelines may be extended, and certain commitments may be impossible to meet under such extraordinary conditions. Mittal’s Apparels shall not be obligated to compensate for any indirect losses resulting from such events. This clause ensures equitable treatment in situations where neither party has control over the interruption or delay.

13. Entire Agreement

These Terms and Conditions constitute the complete and final agreement between the Customer and Mittal’s Apparels regarding all sales, purchases, and related transactions. They supersede any prior discussions, correspondence, representations, or understandings—whether oral or written—relating to the subject matter herein. No modification, addition, or waiver of any part of these Terms shall be valid unless expressly stated in writing and signed by authorized representatives of the Company. If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The failure of Mittal’s Apparels to enforce any right or clause shall not constitute a waiver of that right. This document represents the full understanding between both parties and governs all aspects of their commercial relationship.
